New Brunswick to Lift Restrictive Abortion Barriers Jan. 1, Premier Announces

The province will lift the requirements for two doctors to approve an abortion as medically necessary and for the procedure to be performed only by a specialist. Other provinces allow family physicians to perform the procedure.

The new regulations will take effect Jan. 1 and the abortion will be covered like any other medical procedure, Gallant said Wednesday morning in Fredericton.

“We have identified the barriers and are moving to remove them in order to meet our legal obligations under the Supreme Court of Canada decision and the Canada Health Act regarding a woman’s right to choose,” said Gallant in a statement.

During this year’s election campaign, Gallant vowed to review Regulation 84-20 of the Medical Services Payment Act, which brought the two-doctor rule into effect more than twenty years ago.

In early November, the Prime Minister’s Office said it had yet to begin a review of Regulation 84-20.

Abortion became an issue after the Morgentaler Clinic in Fredericton, the only private clinic in the province, closed over the summer.

Gallant’s Liberals won the September election against the Progressive Conservatives, taking 27 seats to the opposition’s 21.

Abortion clinics in Maine and Quebec say they have since saw a peak the number of New Brunswick women who use their services.

New Brunswick only had two hospitals that could perform the procedure. Abortion advocates say New Brunswick women sometimes have to wait weeks for the procedure.
